What is a Conservation Easement?
A conservation easement is a legal agreement concluded voluntarily between a landowner and a private conservation or governmental organization. Though flexible and customized to meet individual needs and specific property characteristics, this contract documents a landowner's desire to protect the existing conservation values of his or her property by restricting certain uses and limiting development. These easement agreements convey in perpetuity certain rights or interests in real property to a qualified organization (grantee). The easement agreement is recorded at the county or town records office so that all future owners and lenders will learn about the restrictions when they obtain title reports. A conservation easement does not transfer land ownership, but it does bind all subsequent owners of the property to the conditions of the agreement. The grantee has responsibility for enforcing the use restrictions contained in a conservation easement and will periodically inspect the property to verify compliance with the terms of the conservation easement.
